MOTION TO RECONSIDER

7. CASE # Z07-012/JOHNSON: The applicant, Teak Johnson, is requesting a Zone Change on 3.77-acres from ER4M (Residential, 1/2-acre minimum new lot size, single-family site-built and mobile homes) to EC2 (Community Commercial, 5,000 sq. ft. minimum new lot size, retail and personal service uses). The Zone Change will accommodate a proposed mini-storage and RV storage facility. The subject parcel is located south of the City of Las Cruces and I-10, is addressed at 220 Watson Lane, is located within Section 32, T23S, R2E, and can be further identified by Map Code # 4-008-138-122-126. The Extra-Territorial Zoning Commission at its regularly scheduled meeting on November 15, 2007, recommended, with a 5-1-0 vote, approval with conditions. The ETA at its regularly scheduled meeting on December 19, 2007, voted 5-0-0, to approve this case on the consent agenda. However, a motion was made to reconsider the case by Commissioner Perez and staff was directed to place it on the agenda of the next available meeting.

8. CASE # Z07-013/HECK: The applicant, Mark Heck, is requesting a Zone Change on a 6.60-acre parcel from ER4M (Residential, ½ -acre minimum new lot size, single-family site-built and mobile homes) to ER6 (Residential, 5000 sq. ft. minimum new lot size, single-family site-built homes) on 6.0-acres, and EC1 (Neighborhood Commercial, 5-acre maximum new lot size, limited retail and service establishments), on the remaining 0.6-acre of the parcel that fronts Jornada Rd. for the purpose of creating the Saddle Mountain Subdivision of 22 residential lots in the proposed ER6 Zoning, and to build a professional and business office in the proposed EC1 Zoning, as allowed by the ETZ Ordinance Article III, Section 3.1.J.3.a.34. The subject parcel borders the City of Las Cruces just east of Jornada Road and north of Calle Bella within Section 15, T22S, R2E, and can be further identified by Map Code # 4-008-138-203-186. The Extra-Territorial Zoning Commission at its regularly scheduled meeting on November 15, 2007, recommended, with a 5-0-1 vote, approval with conditions. CASE #V07-014/HILL The applicant, Dave Hill, is requesting a Variance of nine (9) feet from the twenty-five (25) foot required rear-yard setback resulting in a sixteen (16) foot rear-yard setback within the ER2 Zoning District (Residential, 2-acre minimum new lot size, single family site-built homes) to construct a 345 sq. ft. accessory building (a crafts studio). The 1.01-acre subject property is addressed at 4625 Baylor Canyon Road, located within Section 10, T22S, R3E, and can be further identified by Map Code # 4-016-128-515-306.
