8. ETZ Subdivision Code Overview, Amendment Process Update and Amendment Prioritization from the City of Las Cruces Community Development Department Staff.

9. Proposed Amendment No. 2011-001 to the to the Las Cruces Extra-Territorial Zoning Ordinance, (No. 88-02, as amended). The ETA will consider the Authorization to Publish the Title and General Summary in order to amend the ETZ Ordinance as follows: Article I, “Purpose, Authority, and Scope of the Code”, Section 1.6: “Definitions”, Article III, “Zoning Districts and Special Use Permits”, Section 3.1: “General Districts: Purposes and Uses”; and Section 3.4: “Home Occupation Permits”, Article VII, “Accessory Buildings”, Section 7.1.A, “Height and Setback Requirements for All Residential Districts”. The ETZ recommended approval on September 22, 2011, by a 7-0-0 vote.

10. CASE # V11-010/DOVE: The applicants, Steven & Maeona Dove, are requesting a Variance from the required twenty-five (25) feet to seventeen (17) feet for the rear yard setback within the ER3 (Residential, 1.0-acre minimum new lot size, single family site-built homes) Zoning District to permit an existing accessory structure. The 2.5-acre parcel is located south of the City of Las Cruces, east of NM Hwy 478 (S. Main St.) and is addressed as 603 Shiloh Rd., Mesilla Park, NM 88047. The parcel is described as being part of Tract 15-1B3A2 situated in Section 15, Township 24 South, Range 2 East, N.M.P.N. of the U.S.R.S Surveys, as recorded in the office of the Doña Ana County Clerk on March 21, 2005 in Deed Book 594, Pages 1928-1929. It can be further identified by Map Code # 4-010-141-360-050.
