CASE # SU11-015/MVBR: The applicant, Mesilla Valley Balloon Rally, Larry Shannon, Agent, is requesting a Special Use Permit for an Open Recreational Use to hold the annual Mesilla Valley Balloon Rally on the 53.48-acre parcel. MVBR received Approval from the ETZ on this same parcel on January 6, 2011, for the January 2011 event (Case # SU10-011). Now they seek long-term approval. The property is zoned ER 2 (Residential, 2 -acre minimum new lot size, single family site built homes) on the west half, and ER 4 (Residential, ½ -acre minimum new lot size, single family site built homes), on the east half, and is addressed as 3228 El Camino Real. It is described as Lot 59 of the Ware Shropshire Tract of Section 36, Township 22 South, and Section 1, Township 23 South, both in Range 1 East, as recorded in the office of the Doña Ana County Clerk in Plat Record 4, Page 2, on January 26, 1910. It can be further identified by Map Code # 4-006-132-331-412.

Proposed Amendment 2011-01 to the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02), Article I, “Purpose, Authority, and Scope of the Code”, Section 1.6: “Definitions”, Article III, “Zoning Districts and Special Use Permits”, Section 3.1: “General Districts: Purposes and Uses”; and Section 3.4: “Home Occupation Permits”, Article VII, “Accessory Buildings”, Section 7.1.A, “Height and Setback Requirements for All Residential Districts”. The ETZ will make a recommendation to the ETA on this issue.
