5. Case # CV11-005: Submitted by Ernesto Chavez, Ruben Chavez, Agent; a request for a Variance of seven feet (7’) from the twenty-five foot (25’) rear-yard setback requirements in the Performance District (PD), resulting in a rear-yard setback of eighteen feet (18’). The applicant seeks the Variance to permit an as-built 1860 sq. ft. site-built dwelling. In addition, in order to pursue a Medium Intensity Application, he seeks a Variance to road-access standards; where fifty feet (50’) of paved ROW is required, the applicant is proposing twenty feet (20’) of unpaved easement. An 1120 sq. ft. mobile home is located on the subject parcel also. The 0.62-acre property is addressed as 2880 Nañez Road, Anthony, NM 88021. It is described as a tract of land situated 2.5 miles north of Anthony within the East ½ of the East ½ of the Northwest ¼ of Northwest ¼ of Section 23, Township 26 South, Range 3 East, NMPH, as recorded in the Doña Ana County Clerk’s office on March 12, 1997 in Book 82, Pages 963-966. The property can be further identified by Map Code # 4-017-154-122-125.

6. Case # CV11-008: Submitted by Mark Brice, a request for a Variance to the minimum rear yard setback requirements within the Performance District. The applicant requests an eleven foot (11’) rear yard setback in order to install a 576 sq ft shed. The requirement is for a twenty-five foot (25’) rear yard setback. The 0.50-acre is located on 11109 Francis Way, southwest of Fort Selden, NM, and is described as being within Section 23, Township 21 South, and Range 1 West; recorded on June 1, 2007 as Instrument # 0719660 in the Doña Ana County Clerk’s office. The parcel can be further identified by Map Code # 3-002-124-015-242.

7. Case # CV11-009: Submitted by Ramon Ronquillo and Maribel Tovar, a request for a Variance to the minimum rear and side yard setback requirements within the Performance District. The applicant requests a zero foot (0’) rear and side yard setback in order to permit two existing barns. The requirement is for a twenty-five foot (25’) rear yard setback and a five foot (5’) side yard setback. The 5.1-acre parcel is located on 208 Mesilla View Drive, in Chaparral, NM and is described as being within Section 22, Township 26 South, and Range 5 East; recorded on May 26, 2006 as Instrument # 0617915 in the Doña Ana County Clerk’s office. The parcel can be further identified by Map Code # 4-028-154-346-106.
