6. CASE # SU11-011 / FUQUA: The applicant, Kimberly Fuqua, is requesting a Special Use Permit to establish and operate a dog training business at her residence on a 2.0-acre parcel located within the ER3 (Residential, 1-acre minimum new lot size, single-family site built homes) Zoning District. The subject property contains a 2,194 sq. ft. site built home and a 900 sq. ft. detached garage and is addressed as 4208 Escondido Ln., Las Cruces, NM 88005. It is located west of the City of Las Cruces within Section 21, Township 23 South, Range 3 East and is described as being a part of USRS Tract 8-38 and part of Hidgon’s Acreage Subdivision as recorded in the office of the Doña Ana County Clerk on November 22, 1915 in Book 4, Page 56, and can be further identified by Map Code # 4-003-136-460-120.

7. CASE # Z11-003 / JENNIE LIMÓN: The applicants, Jennie Limón, Patricia & Frank Arreola, Agents, are requesting a Zone Change from ER 3 (Residential, 1-acre minimum new lot size, single family site-built homes) to ER 6 (Residential, 5,000 sq. ft. minimum lot size, single family site-built homes) to facilitate the division of property for an estate settlement. The subject property will be subdivided later into 0.217 and 0.333 acre parcels to allow the heirs to receive their property. The 0.55-acre parcel is located south of the City of Las Cruces and is addressed as 4777 South Hwy. 28, Las Cruces, NM 88005. The property is described as being a part of USRS Tract 13-22C, NMPM of the USRS Surveys located within Section 5, Township 24 South, Range 2 East, as recorded in the Doña Ana County Clerk’s Office on March 21, 2006, in Book 695, Page 170-171, and can be further identified by Map Code # 4-008-139-067-485.

Proposed Amendment 2011-01 to the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02), Article I, “Purpose, Authority, and Scope of the Code”, Section 1.6: “Definitions”, Article III, “Zoning Districts and Special Use Permits”, Section 3.1: “General Districts: Purposes and Uses”; and Section 3.4: “Home Occupation Permits”, Article VII, “Accessory Buildings”, Section 7.1.A, “Height and Setback Requirements for All Residential Districts”. The ETZ will make a recommendation to the ETA on this issue.
