9. CASE # V11-005/DUGAN: The applicants, Irvin and Lynn Dugan, are requesting a Variance of twelve feet (12’) to the required rear yard setback of twenty feet (20’), per Article IV, Section 4.1 of the ETZ Ordinance, resulting in an eight foot (8’) rear yard setback. They seek to construct a 228 sq. ft. bedroom addition to the existing 411 sq. ft. accessory living quarters on the property. The entire subdivision was approved for a Variance on April 16, 2003; this lot was granted a “southern side yard [setback] of five feet (5’)”. The 0.19-acre parcel is zoned ER 7 (Residential, 5000 sq. ft. minimum new lot size, single-family site-built homes), is located north of the City of Las Cruces, immediately north of Picacho Hills Dr., within Section 17, Township 23 South, and Range 1 East, and is addressed as 1139 Pueblo Gardens Court. The property is described as Lot 2 of the Pueblo Gardens Subdivision, recorded in the Office of the Doña Ana County Clerk on September 6, 2005, in Book 21, Page 319-320, and can be further identified by Map Code # 4-002-135-456-240.
