CASE # SU11-005 / TUNE: The applicants, George and Margaret Tune, Rob Jones of Verizon Wireless, Agent, are requesting a Special Use Permit to construct a seventy-four foot (74’) tall cell tower on a 5.4-acre parcel per Section 4.2.E.2.b of the ETZ Ordinance. The property is located east the City of Las Cruces, between Moongate and Brahman Roads and is zoned EC 1 (Commercial, 5-acre maximum new lot size, neighborhood commercial). The parcel is described as a section of the northeast quarter of Section 9, Township 22 South, and Range 3 East, as recorded in the Doña Ana County Clerk’s office in Book 38, Pages 705-706, on January 26, 1996. The parcel can be further identified by Map Code # 4-015-128-330-229.

CASE # SU11-008 / VERIZON: The applicant, Verticom for Verizon Wireless, Denise Cardinal, Agent, is requesting a Special Use Permit to construct a 75’ tall cell tower on a 4.04-acre parcel per Section 4.2.E.2.b of the ETZ Ordinance. The property is located north of the City of Las Cruces, east of North Valley Drive and south of Lopez Road, and is zoned ER 2 (Residential, 2-acre minimum new lot size, single family site built homes). It is described as being part of the USGLO surveys of Section 34, Township 22 South, Range 1 East, as recorded in the office of the Doña Ana County Clerk in Book 386, Pages 12-13, on October 7, 1994. The parcel can be further identified by Map Code # 4-005-132-065-085.

Proposed Amendment 2011-01 to the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02), Article I, “Purpose, Authority, and Scope of the Code”, Section 1.6: “Definitions”, Article III, “Zoning Districts and Special Use Permits”, Section 3.1: “General Districts: Purposes and Uses”; and Section 3.4: “Home Occupation Permits”, Article VII, “Accessory Buildings”, Section 7.1.A, “Height and Setback Requirements for All Residential Districts”. The ETZ will make a recommendation to the ETA on this issue.
