5. CASE # PUD10-003/Type 2: Submitted by Johnny’s Septic Tank Company, a request for a Planned Unit Development/Type 2 for a private septic disposal facility with a discharge capacity of up to 20,000± gallons per day. The facility will incorporate six (6) lagoons to be constructed in three (3) phases, two (2) lagoons per phase. The fifteen (15) acre site, zoned PD (Performance District) is located east of Mesquite, NM and is described as part of the SE ¼ of the SW ¼ and the S ½ of the SE ¼ of Section 21, Township 24 South, Range 3 East; recorded on January 20, 2010 as Instrument # 1001692 in the office of the Doña Ana County Clerk. The parcel is on County Road B-059 can be further identified by Map Code # 4-015-143-330-066.

6. CASE CV10-011: Submitted by Leazar Avitia, a request for a Variance to the minimum rear yard setback requirements. The applicant requests a twelve foot (12’) rear yard setback in order to bring into compliance a 1,144 sq ft existing site built home; where a twenty-five foot (25’) rear yard setback is required. The 0.90-acre parcel, zoned PD (Performance District) is in Chaparral, NM. It is described as Block 9, Lots 10 and 11 of the Desert Aire Estates Subdivision within Section 7, Township 26 South, Range 5 East; recorded on January 12, 2004 in Book 489, Page 1789 in the Doña Ana County Clerk’s office.
