9. CASE # V10-007/SANCHEZ: The applicants, Aaron and Renae Sanchez, are requesting a Variance of five feet (5’) to the side yard setback requirement of ten feet (10’), and a Variance of nineteen feet (19’) to the twenty-five foot (25’) rear yard setback requirement within the ER 3/4 Zoning District (Residential, 3/4-acre minimum new lot size, single-family site built homes), to construct a 1,275 sq. ft. accessory building (a garage). The 0.75-acre parcel is located north of the City of Las Cruces, north of Harvey Farm Road, and is addressed as 7365 La Fleche Place, Las Cruces, NM. The subject property is described as Lot 175 of the Rancho Del Gallo, Unit II Subdivision located within Section 9, Township 22 South, Range 1 East, as recorded in the Office of the Doña Ana County Clerk on June 6, 2005 in Plat Book 21, Pages 251-253. The parcel can be further identified by Map Code # 4-003-128-230-438.

10. CASE # Z10-007/SMITH: The applicants, Mary and William B. Smith, Scott Rutledge, Agent, are requesting a Zone Change on a 4.24-acre parcel from EC1 (Neighborhood Commercial, 5-acre maximum lot size, limited retail and service establishments serving nearby neighborhoods) to EC2 (Community Commercial, 5,000 sq. ft. minimum lot size, retail and personal services and some commercial recreational uses) for the purpose of developing a commercial retail and office center to be constructed in phases. The subject parcel is located south of the City of Las Cruces, east of NM Hwy 478, and is addressed as 4995 S. Main St. It is described as being a part of U.S.R.S Tract 13-17A3B of the Doña Ana Bend Colony Grant, within Section 4, Township 24 South, Range 2 East as recorded in the Office of the Doña Ana County Clerk on March 29, 1972, in Book 219, Pg 488. The subject property can be further identified by Map Code # 4-009-139-082-277. The ETZ Commission, at its regularly scheduled meeting of September 16, 2010, approved this Zone Change Request by a vote of 4-0-0.

11. CASE # EAP10-002/QUÉSADA: The applicants, René and Margarita Quésada, Ted Scanlon, of Scanlon-White, agent, are appealing the August 19, 2010 decision of the ETZ Commission to deny CASE # Z10-002, a Zone Change Request on a 2.56-acre parcel from EC 1 (Neighborhood Commercial, 5-acre maximum new lot size) to EI1 (Light Industrial, 5000 sq. ft. minimum lot size) to have a business office and to occasionally store trucks and trailers on the property. The parcel is located north of the City of Las Cruces on the corner of Weisner Road and Rhonda Lane within Section 8, Township 22 South, and Range 3 East. It is described as being Lot 23, Block “B” of the Woodburn Addition of the USGLO Surveys, recorded on January 7, 1977 in Book 12, Pages 84-85 in the Doña Ana County Clerk’s office and can be further identified by Map Code # 4-014-128-242-148.

12. CASE # ETZS-10-008Wa: An appeal of the ETZ Commission denial of a waiver request to subdivision requirements for a subdivision proposal known as Case ETZS-10-008, Johnson Estates Subdivision No. 2, Replat A. The applicant made a request for the ETZ Commission to waive the requirements for road improvements to Shalem Colony Trail, a County road and Minor Arterial roadway according to the MPO Thoroughfare Plan, which was denied on September 2, 2010. The subject property is located near the intersection of Shalem Colony Trail and West Picacho Avenue (Highway 70). Submitted by Centerline Services for Bryan Johnson and Picacho Valley Group, property owners.

Proposed Amendment 2010-01: Section 2.6.C, “Administrative Special Use Permits”, Article III, “Mobile Home and Recreational Vehicle Parks”, Section 3.5.B, “Application and Action” and Article VII, “Accessory Building”, Section 7.2.F, “ETZ Commission Approval required for Accessory Living Quarters”, to allow for administrative approval of all ETZ Special Use Permits. The ETZ Commission, at a regularly scheduled meeting on September 16, 2010, recommended approval of this amendment by a vote of 4-0-0.
