5. CASE CV10-007: Submitted by Verde Santa Teresa LLC, a request for a Variance to road access standards within the Performance District in order to pursue a Claim of Exemption. The Claim of Exemption will create a 209 acre parcel. The partition is part of a future electric generating solar facility that requires sixty feet (60’) of right-of-way or easement with thirty-six feet (36’) of improved roadway consisting of 1½ HMAC. The applicant is proposing a forty-five foot (45’) private access and utility easement with twenty-five feet (25’) of graveled surface roadway. The properties are located southwest of Santa Teresa; identified as being within Township 29 South, Range 3 East, and Section 6 & 7; recorded on December 31, 2003 in Book 487, Pages 1834 -1901 in the office of the Doña Ana County Clerk. The parcels can be further identified by Map Code Nos. 4-013-169-264-264, 4-013-170-264-132 and 4-013-170-260-400.

CASE # MSPA10-001: Submitted by Verde Santa Teresa LLC, a request for a Major Site Plan Amendment to a previously approved Planned Unit Development Overlay Zone Case # PUD(2)09-004, for an electric generating solar power facility. The amendment consists of a change in facility infrastructure improvements and a decrease in site disturbance. The applicant is proposing two site plan options. The properties are located southwest of Santa Teresa; identified as being within Township 29 South, Range 3 East, and Section 6 & 7; recorded on December 31, 2003 in Book 487, Pages 1834 -1901 in the office of the Doña Ana County Clerk. The parcels can be further identified by Map Code Nos. 4-013-169-264-264, 4-013-170-264-132, and 4-013-170-260-400.
