9. CASE # EAP10-001 / SMITH: The applicant, William B. Smith, Glen Hall, agent, is appealing the April 22, 2010 decision of the ETZ Commission to deny CASE # Z08-017/SMITH, a Zone Change Request on a 0.5-acre parcel from EC2 (Community Commercial, 5,000 sq. ft. minimum new lot size) to EI1 (Light Industrial District, 5,000 sq. ft. minimum new lot size) to operate a machine shop. The subject property is located south of the City of Las Cruces, is addressed at 3680 Harrelson St., within Section 29, Township 23 South, Range 2 East. The parcel is described as Lots # 7 & 8, Block 12, of the Mesilla Park Townsite filed in Book 2, Page 31, on August 25, 1887, in the Office of the Doña Ana County Clerk and can be further identified by Map Code # 4-008-138-092-007. This case was postponed to this date at the regularly scheduled meeting of the ETA on July 21, 2010.

10. CASE # ETZS-09-045Wa: An appeal of the ETZ Commission denial of a waiver request to subdivision requirements for a subdivision proposal known as Case ETZS-09-045, Talavera Subdivision, Unit 2, Tract 3, Replat of Lot 7. The applicant made a request for the ETZ Commission to waive the requirements for road improvements to Rockhouse Road, a 50-foot wide road and utility easement, which was denied on June 3, 2010. The subject property is located at the southeast corner of Soledad Canyon Road and Rockhouse Road. Submitted by BRG for Jeff and Ginette Weiner, property owners. This case was postponed to this date at the regularly scheduled meeting of the ETA on July 21, 2010.
