5. Case # CV10-003: Submitted by Theresa Fisher, a request for a Variance to road access standards within the Performance District. The applicant is proposing a thirty (30) foot graded county maintained right-of-way in order to pursue a Non-Residential Application for a Winery with future retail and a caretaker residential area; where a fifty (50) foot wide right-of-way or easement with twenty-four (24) feet of improved roadway is required. The 10.00-acre parcel is located on La Viña Rd, south of Chamberino, NM. The property is identified as being within Section 30, Township 26S, Range 3E, recorded on April 3, 2009 as Instrument # 0909003 in the Office of the Doña Ana County Clerk, and can be further identified by Map Code # 4-013-155-135-092.
