CASE # V09-008 / WILSON: The applicant, Donald Wilson, is requesting a Variance of five feet (5’) to the required side yard setback of ten feet (10’), per Article VII, Section 7.1.A.2 of the ETZ Ordinance, resulting in a five foot (5’) side yard setback, for accessory buildings of 400 square feet or less within the Extra-territorial Zone (ETZ). He seeks to construct a 320 sq. ft. accessory building. The 0.33-acre subject parcel is zoned ER 2 (Residential, 2-acre minimum new lot size, single-family site-built homes), is located north of the City of Las Cruces, immediately east of North Valley Dr., within Section 35, Township 22 South, and Range 1 East, and is addressed as 1082 Villita Loop. It is described as Lot 30 of Block 1 of the Country Walk Estates, Phase I, recorded in the Office of the Doña Ana County Clerk on January 23, 1996, in Book 38, Page 793, and can be further identified by Map Code # 4-005-132-063-178.
