11. CASE # V09-007/HENRY: The applicant, Clayton Henry, is requesting a Variance to the side yard setback requirement within the ER 3 District (Residential, 1-acre minimum new lot size, single-family site built homes) and two Variances from the minimum setback distance between structures, to construct a 1,075 sq. ft. RV garage on the east side of the residence. Article III, Section 3.1.C.1.b of the ETZ Ordinance requires a fifteen foot (15’) side yard setback. A Variance of ten feet (10’) is being requested resulting in a five foot (5’) side yard setback. The applicant is also requesting Variances of 1.5 feet (1.5’) and five feet (5’) from the required 10 foot (10’) setback between structures per Article IV, Section 4.2.A.4, to allow for the construction of the RV garage. The 1.02-acre subject parcel is located east of the City of Las Cruces, south of Dripping Springs Rd., within Section 17, Township 23 South, Range 3 East, and is addressed as 3930 Desert Broom Ct. The subject property is described as Lot 2 Block J of the Desert Mirage Subdivision as recorded in the office of the Doña Ana County Clerk June 2, 1999, in Book 19, Pages 286-287, and can be further identified by Map Code # 4-014-135-349-413.

CASE # Z09-004/GARCIA-LUCERO: The applicants, Robert & Yolanda Garcia and Michael Lucero, (Jay Miller, Agent), are requesting a zone change on four parcels totaling 35.7-acres from ER3M (Residential, 1-acre minimum new lot size, single-family site-built and mobile homes) and EC1 (Neighborhood Commercial, 5,000 sq. ft. minimum lot size) to EI1 (Light Industrial District, 5000 sq. ft. minimum lot size) for the purpose of relocating a light fabrication business, and developing the parcels for other unspecified light industrial uses. The subject parcels are located south of the City of Las Cruces, east of Interstate 10, at the southeast corner of Las Alturas Dr. and Sunny Ln., within Section 3, Township 24 South, Range 2 East. The four subject parcels are described as part of Lots 18, 19, 20, & 21, of Block 6 of the EBL&T Subd. “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 8.582-acres, and part of Lots 18, 19, & 20, of Block 7 of the EBL&T Subd. “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 12.266-acres, and part of Lots 5, 6, & 7, of Block 7 of the EBL&T Subd. “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 14.84-acres. The parcels can be further identified by Map Code Nos. 4-010-139-379-322, 4-010-139-499-314, 4-010-139-432-314 and
4-010-139-513-315. The Extra-Territorial Zoning Commission at its regularly scheduled meeting on December 17, 2009, recommended approval of the Zone Change, by a 5-2-0 vote.
