6. CASE # SU09-013/CATHOLIC DIOCESE OF LAS CRUCES: The applicant, the Catholic Diocese of Las Cruces, Manuel Leyva, agent, is requesting a Special Use Permit to construct an 8000 sq. ft. church. Article III, Section 3.1.C.1.d.8, of the Ordinance requires a Special Use Permit in the ER 3M District for a church. Pursuant to Article III, Section 3.3.B.4 of the Ordinance, the applicant, with CASE # V09-003, is also seeking a Variance of eight feet (8’) to the forty-five foot (45’) maximum height to the church structure for the placement of the bell tower and cross, resulting in a total height of fifty-three feet (53’). The 10-acre subject parcel is zoned ER 3M (Residential, 1-acre minimum new lot size, single-family site-built and mobile homes) and is addressed as 5035 Holsome Road. It is located east of the City of Las Cruces, south of US Hwy 70, within Section 17, Township 22 South, and Range 3 East, as recorded in Book 302, Page 852 in the Office of the Dona Ana County Clerk on March 31, 1985, and can be further identified by Map Code # 4-014-129-121-079.

CASE # SU09-015/GONZALES: The applicant, Mark Gonzales, is requesting a Special Use Permit within the ER 3M Zoning District (Residential, 1-acre minimum new lot size, single-family site built and mobile homes) to operate a commercial bird dog training and kennel business on a 1.16-acre parcel. Pursuant to Article III, Section 3.1.C.1.d, commercial kennels require a Special Use Permit in the ER 3M District. The proposed dog kennel business will be addressed at 3980 Sparrow Rd., Las Cruces, NM 88007. The subject property is located within Section 9, Township 23S, Range 1E, is described as U.S.R.S Tract 8-4C as recorded in the Office of the Doña Ana County Clerk in Book 10, Pages 65-66 on April 7, 1995 and can be further identified by Map Code # 4-003-134-266-430.

CASE # Z09-004/GARCÍA-LUCERO: The applicants, Robert & Yolanda García and Michael Lucero, (Jay Miller, Agent), are requesting a Zone Change on three parcels totaling 35.7-acres from ER3M (Residential, 1-acre minimum new lot size, single-family site-built and mobile homes) and EC1 (Neighborhood Commercial, 5,000 sq. ft. minimum lot size) to EI1 (Light Industrial District, 5000 sq. ft. minimum lot size) for the purpose of relocating a light fabrication business, and developing the parcels for other unspecified light industrial uses. The subject parcels are located south of the City of Las Cruces, east of Interstate 10; at the southeast corner of Las Alturas Dr. and Sunny Ln., within Section 3, Township 24 South, Range 2 East. The three subject parcels are described as part of Lots 18, 19, 20, & 21, of Block 6 of the EBL&T Subdivision “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 8.582-acres, and part of Lots 18, 19, & 20, of Block 7 of the EBL&T Subdivision “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 12.266-acres, and part of Lots 5, 6, & 7, of Block 7 of the EBL&T Subdivision “B” as filed in Book 4 Page 24 in the Office of the Doña Ana Clerk on August 4, 1911, containing 14.843-acres. The parcels can be further identified by Map Code Nos. 4-010-139-379-322, 4-010-139-499-314, and 4-010-139-432-314.
