4. Case# CV09-005: Submitted by Charles Sanders, a request for a Variance to the minimum rear yard setback requirement. The applicant requests a ten (10’) five inch (5/'/) rear yard setback in order to place a metal garage structure; where a twenty-five foot (25’) rear yard setback is required. The subject parcel is located at 222 West Lisa Drive in Chaparral, New Mexico. The property is identified as being within Section 21, Township 26 South, Range 5 East, recorded on February 26, 2001 in Book 255, Page 1104 in the Doña Ana County Clerk’s office. The parcel can be further identified by Map Code # 4-027-154-210-122.

5. Case# PUD09-004/Type 2: Submitted by Verde Santa Teresa LLC, a Planned Unit Development Overlay Zone Type 2 and Detailed Site Plan. The applicant is proposing an electrical generating facility consisting of a 92 megawatt concentrated solar power plant. The facility will encompass approximately 443.84 acres in the Santa Teresa border area located approximately one half mile east of the Pete V. Domenici International Beltway (NM136) and approximately one half mile north of Bi-National Avenue. The property is also identified as being within a portion of Township 29 South, Range 3 East, Section 5, Township 29 South, Range 3 East, Section 6, Township 29 South, Range 3 East, Section 7, Township 29 South, Range 3 East, and Section 8.

The applicant is proposing to remove and replace a three hundred foot (300’) tall self-supporting tower for cellular telephone service. The 20.0-acre parcel is in Performance District (PD) zoning. It is located east of the City of Las Cruces, and immediate east of the Extra-territorial Zone, Organ, NM, and the San Augustin Pass, on the north side of US Hwy 70. The parcel is within Section 5, Township 22 South, and Range 4 East, recorded on December 20, 2002 in Book 385, Pages 1174-76 in the Doña Ana County Clerk’s office. The parcel can be further identified by Map Code # 4-020-127-022-095.
