8. CASE # V09-004/JOHNSON: The applicant, Gregory W. Johnson, is requesting a Variance of six feet (6’) to the required side yard setback requirement of ten feet (10’), per Article VII, Section 7.1.A.2 of the ETZ Ordinance, resulting in a four foot (4’) side setback, for accessory buildings of 400 square feet or less within the Extra-territorial Zone (ETZ). This would allow two (2) 160 sq. ft accessory buildings, for a total accessory building size of 320 sq. ft. The 0.51-acre subject parcel is zoned ER 3 District (Residential, 1-acre minimum new lot size, single-family site built homes), is located north of the City of Las Cruces, immediately west of North Valley Dr., within Section 27, Township 22 South, and Range 1 East, and is addressed as 1423 Carol Ann Court. It is described as Lot 7 of Block 2 of the Taylor Farm Estates, No. 2, recorded in the Office of the Doña Ana County Clerk on April 12, 1978, in Book 12, Page 176, and can be further identified by Map Code # 4-004-131-373-458.

9. CASE # V09-005/ST. MARYS: The applicant, St. Mary’s Anglican Church, Bishop Melvin Pickering, Agent, is requesting a Variance to the rear yard setback requirement within the ER 2 District (Residential, 2-acre minimum new lot size, single-family site built homes) to place a 2560 sq. ft. double-wide manufactured home to be used as the Parish residence. The request is to place a manufactured home ten feet (10’) from the rear property line in lieu of the twenty-five foot (25’) setback requirement of Article III, Section 3.1.B.1.b of the ETZ Ordinance for a fifteen foot (15’) variance to the rear yard setback. The 0.47-acre subject parcel is located north of the City of Las Cruces, east of North Valley Dr., within Section 4, Township 22 South, and Range 1 East, and is addressed as 7975 Doña Ana Rd. It is described as part of Tracts 23A and 23C of the Bureau of Reclamation Map #3, recorded in the Office of the Dona Ana County Clerk on April 26, 1985 in Book 295, Page 602 and can be further identified by Map Code # 4-003-127-075-230.

CASE # E-05-085 Proposed Revision to La Mancha Estates, Phase 2a Final Plat and Construction Drawings: City staff is seeking direction to a proposed revision to the final plat and construction plans for the subdivision known as La Mancha Estates for the sole purpose of allowing individual septic systems for each of the 29 individual residential lots platted within Phase 2a as originally reflected on the approved preliminary plat. The subject property is located east of South Fairacres Road just south of Interstate 10.
