The Las Cruces Extra-Territorial Zoning Commission agenda for a public hearing to be held on Thursday, November 5, 2009 at 7:00 p.m. in the County Commission Chambers at 845 N. Motel Boulevard, Las Cruces, New Mexico.

1. Case ETZS-09-053: An appeal of an administrative interpretation by the City of Las Cruces Community Development Director regarding the ETZ Subdivision Ordinance, Article IV., Design Standards, Section 4.4 Cluster Subdivision, 4.4G General Provisions, General Provision #2. The applicant proposes to construct a single family home within the 4.753 +/- open space designated for agricultural uses of an approved Cluster Subdivision known as Esterlina Estates comprised of 17 residential lots on 17.013+/- acres. The City of Las Cruces Community Development Director has concluded that the proposed single family home would result in the subdivision exceeding the overall density allowed under the ETZ Zoning and ETZ Subdivision Codes. The subdivision is zoned ER3 (Residential, One Acre Lots, Cluster Development, Site Built Home Only). The subdivision is located east of North Fairacres Road and west of the Picacho Drain.
