4. Case# CV09-004: Submitted by Francisco Rodriguez, a request for a Variance to the minimum side and rear yard setback requirements. The applicant requests a two foot (2’) nine inch (9”) side yard setback for an existing 21-foot by 23-foot carport constructed without a permit; where a five foot (5’) side yard setback is required. The applicant is also proposing a ten foot (10’) rear yard setback where a twenty-five foot (25’) rear yard setback is required. The subject parcel is located at 570 Eisenhower Avenue, Salem, New Mexico. It is described as being Lot 15, Block 15 in the Ogaz Addition to Salem, NM as recorded December 12, 1913 in Book 1, Page 13, in the Office of the Doña Ana County Clerk. It is within Section 25, Township 18S, Range 4W, and can be further identified by Map Code # 3-019-107-510-468.

5. CASE # MP09-001: Submitted by Verde Realty, the applicant is seeking approval of an amendment to the Santa Teresa Master Plan (“Master Plan”) for approximately 21,459 acres of land originally approved by Doña Ana County on 11/10/05 (DAC `Resolution No. 05-110) and subsequently amended on November 12, 2008 (DAC Resolution No. 08-110). This proposed amendment provides for additional industrial and commercial land uses to accommodate and buffer a proposed solar power facility. The 443.84 ± acre Concentrated Solar Power Facility proposed by New Mexico Suntower, LLC, is to be located in the southeast quadrant of the proposed Santa Teresa development, east of Domenici Highway (NM 136), south of the abandoned UPRR tracks, west of the escarpment, and north of Bi-National Avenue. The proposed Master Plan amendment also provides revisions to the underlying roadway network which are necessitated by the additional industrial and commercial land uses required to support the proposed solar power facility. These changes, in turn, necessitate minor changes to the Open Space, Retail, Transit, School, Drainage, Water Supply, and Wastewater Framework Plans that are also components of the Master Plan document. The Master Planned area is located within Township 28 South, Range 2 East, Various Sections; Township 28 South, Range 3 East, Various Sections; Township 29 South Range 3 East, Various Sections: Township 29 South, Range 2 East, Various Sections; and Township 29 South, Range 4 East, as recorded on December 31, 2003 in Book 487, Pages 1834-1901 in the Office of the Doña Ana County Clerk.
