7. CASE #V09-001 / MOORE: The applicants, David & Debbie Moore, are requesting a Variance to the rear yard setback requirement within the ER4M District (Residential, 1/2-acre minimum new lot size, single-family site-built and mobile homes) to construct a 1,200 sq. ft. garage and shop accessory building. Article III, Section 3.1.E.1.b of the ETZ Ordinance requires a twenty-five foot (25’) rear yard setback. A Variance of fifteen feet (15’) is being requested resulting in a ten foot (10’) rear yard setback. The 0.5-acre subject parcel is located north of the City of Las Cruces, west of Doña Ana Rd., within Section 26, Township 22 South, Range 1 East, and is addressed as 606 Shadow Valley Dr. The subject property is described as Lot 9 of the Sunrise Subdivision No. 1, recorded in the office of the Doña Ana County Clerk January 6, 1978, in Book 12, Pgs. 156-157, and can be further identified by Map Code # 4-005-131-098-009.

8. CASE # EAP09-002 / IGLESIA DE JESUCRISTO APOSTOLICA EBENEZER: The applicant, Iglesía de Jesucristo Apostólica Ebenezer, Daniel Corona, agent, is appealing the DENIAL by the ETZ Commission at the regular meeting of May 21, 2009, on a 1-5-0 vote, of a Special Use Permit request to construct a 5920 sq. ft. church. The 1.86-acre subject parcel is zoned ER 4M (Residential, ½-acre minimum new lot size, single-family site-built and mobile homes) addressed as 9095 Red Roof Trail, and is described as part of Lot 4 of the Woodburn Subdivision #4, recorded on February 4, 1994 in Book 18, Pages 13-14 in the Office of the Doña Ana County clerk . Pursuant to Article III, Section 3.1.E.1.d.7, churches require a Special Use Permit in the ER 4M District. The parcel is located east of the City of Las Cruces, north of US Hwy 70, within Section 8, Township 22 South, and Range 3 East, and can be further identified by Map Code # 4-014-128-244-328.
