6. CASE # EAP08-006/ELLIOTT: The applicants, Doyle and Catherine Elliott, Ray Mancera, agent, are appealing a decision of the ETZ Commission to deny CASE # SU08-014/ELLIOTT, for a Special Use Permit to a) Erect a Commercial Tower in a Residential Zone per Section 4.2.E.2.b of the Ordinance, and b) Exceed the maximum height of 75’ in order to build a 90’ monopole tower as per Section 4.2.E.2.a.1 of the Ordinance. This11.30-acre parcel is zoned ER3 (Residential, 1-acre minimum new lot size, single-family site-built homes), and is addressed at 5503 South Highway 28, Las Cruces, NM. It is described as Lot 1 of the Elliott Tracts, recorded in Book 21, page 12 in the Office of the Doña Ana County Clerk. The parcel is located south of the City of Las Cruces, within Section 8, Township 24 South, Range 2 East and can be further identified by Map Code # 4-008-140-364-392.

CASE # V08-010 / WELLSPRING CHURCH: The applicant, The Wellspring Church, Samuel Ritchey, agent, is requesting a Variance to Section 6.6.A Parking Area Surface standards and to Section 4.2.C.2.e Landscaping and Buffering Requirements. A 5,293 sq. ft. chapel and portico will be constructed and the existing 1,212 sq. ft. chapel will be converted into multi-use facilities in accordance with SU08-005, granted by the ETZ Commission on April 17, 2008. The 3.0-acre subject parcel is located north of the City of Las Cruces, addressed at 140 W. Taylor Rd., and is within Sections 23 & 26, Township 22 South, Range 1 East. The parcel is described as USRS Tracts 5-18D1 & 5-18D2, and can be further identified by Map Code # 4-005-131-345-028.

8. CASE # #V08-011/REGALADO: The applicant, Juan Regalado, is requesting a Variance of 15 ft. from the required rear yard setback of 25 ft., resulting in a 10 ft. setback, and a Variance of 5 ft. from the required side yard setback of 10 ft. resulting in a 5 ft. setback, to construct a 560 sq. ft. accessory building. The 0.33-acre parcel is zoned ER 5M (Residential, ⅓-acre minimum new lot size, single-family site-built and mobile homes) addressed at 5207 Geronimo Trail; and is described as Block 2, Lot 23 of Mesa La Jolla Unit #2 Subdivision recorded in Book 15, pages 372-373 in the Office of the Doña Ana County Clerk. It is located north of the City of Las Cruces, within Section 18, Township 22 South, Range 2 East and can be further identified by Map Code #
4-007-129-125-333.
