6. CASE #V08-009/WELCH: The applicant, Charles W. Welch, is requesting a Variance to the maximum 3000 sq. ft. accessory building footprint allowed per Section 7.1.B of the ETZ Ordinance to exceed the permitted size by 3372 sq. ft. to construct an additional 2520 sq. ft. garage in the ER3M Zoning District (Residential, 1-acre minimum new lot size, single-family site-built and mobile homes). The current accessory building footprint surpasses the 3000 sq. ft. standard by 852 sq. ft. The 5.0-acre subject parcel is at 6589 Coyote Road, located north of the City of Las Cruces, west of Moongate Road, within Section 5, Township 22 South, Range 3 East, and can be further identified by Map Code # 4-014-127-360-462.

7. CASE # EAP08-004/SHITAL, LLC: The applicant, Shital, LLC. (Paul Pompeo, Agent), is appealing the recommendation of the ETZ Commission to Deny, by a vote of 3-4-0, CASE # Z08-008/SHITAL, LLC., for a Zone Change on two parcels totaling 36.59 acres from ER2 (Residential, 2-acre minimum new lot size, single-family site built homes) to ER3 (Residential, 1-acre minimum new lot size, single-family site built homes) for a proposed nineteen (19) lot subdivision. The 16.09 and 20.50 acre subject parcels are located east of the City of Las Cruces in the northwest quadrant of the intersection of Achenbach Canyon Road and Chippewa Trail in the Soledad Vista #3 Subdivision within Section 20, Township 22 South, Range 3 East. The parcels can be further identified by Map Code #s 4-014-136-408-433 and # 4-014-136-488-463.

8. CASE # EAP08-005/LALLOO: The applicant, Kishor Lalloo (Paul Pompeo, Agent), is appealing the recommendation of the ETZ Commission to Deny, by a vote of 0-7-0, CASE # Z08-010/LALLOO for a Zone Change on a 14.31-acre parcel from ER3M (Residential, 1-acre minimum new lot size, single-family site built and mobile homes) to ER3/4M (Residential, ¾-acre minimum new lot size, single-family site built and mobile homes) for a proposed sixteen (16) lot subdivision. The subject property is located northeast of the City of Las Cruces at the northwest corner of the intersection of Jack Rabbit Road and Luna Vista Road and is described as Lot #3 of the Dupuis Estates Subdivision within Section 4, Township 22 South, Range 3 East. The parcel can be further identified by Map Code # 4-015-127-358-229.
