6. CASE #Z08-009/JOHNSON The applicant, Larry Johnson (Marvin McGee, agent) is requesting a Zone Change on a 16.19-acre parcel from ER3M (Residential, one-acre minimum new lot size, single-family site-built and mobile homes) to EC2 (Community Commercial, 5,000 sq. ft. minimum new lot size) for the purpose of building a mini storage and recreational vehicle storage business as permitted in Section 3.1.N.3.b.1 of the Ordinance. The subject parcel is south of the City of Las Cruces, west of I-10 on the corner of Stern Dr. and Harper Rd. within Section 25, Township 24 South, Range 2 East, and can be further identified by Map Code # 4-012-143-333-012. The ETZ Commission at its regularly scheduled meeting on July 17, 2008, recommended approval with a 6-0-0 vote. The ETA at its regularly scheduled meeting on August 18, 2008, voted 5-0-0 to postpone this case.

7. CASE # EAP08-003/DENCO, INC: The applicant, Denco, Inc, David Church, agent, is appealing a June 19, 2008 decision of the ETZ Commission, to deny, by a vote of 3-3-0, CASE # Z08-007/DENCO, INC., for a Zone Change on the north 9.65 acres of a 19.65-acre parcel from ER2 (Residential, 2-acre minimum new lot size, single-family site-built homes) to EC3 (Commercial, Planned Commercial District, 3-acre minimum district area) for this military service provider to establish a central office with shipping, receiving, operations, and storage. If approved, the applicant will then proceed with the subdivision process to subdivide the parcel between the commercial and residential portions of the property. The parcel is located northeast of the City of Las Cruces south of US Hwy 70 at 10990 Bataan Memorial East within Section 10, Township 22 South, Range 3 East, and can be further identified by Map Code # 4-016-128-296-065.

8. CASE # A08-001/ Amendments to the ETZ Zoning Ordinance. The Extra-Territorial Zoning Authority will consider the following amendments to the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02, as amended)

a. Title: Article II, “Administration of the Zoning Code”, Section 2.1.G “Public Hearing and Notice Requirements”.

General Summary: This amendment proposes that ETZ notification requirements be modified to reduce the impact of postage on Doña Ana County and applicants. Certified mail, return receipt requested, shall only be required for ETA final decisions on Zone Change Requests or Initial Zoning Requests. It also strengthens the section addressing signs. It requires applicants to construct sturdy sign backings and to post them for easier visibility.

b. Title: Article II, “Administration of the Zoning Code”, Section 2.2.C, ”Building Permits and Plans”
General Summary: This amendment proposes that no dwelling unit in the County shall receive a Certificate of Occupancy (C.O.) until all the requirements of the building code are met, and any violations of said Code are resolved.
c. Title: Article II, “Administration of the Zoning Code”, Section 2.4.I: “Interpretations of District Boundaries”.
General Summary: This Amendment proposes that the entire area of any parcel that is intersected by the Extra-Territorial Zoning boundary line shall be considered wholly within the ETZ.

d. Title: Article VIII, “Keeping of Animals”

General Summary: This amendment proposes that the keeping of large animals on parcels of one-acre or greater in the ER3/4 and ER4 Zoning Districts shall not require a Special Use Permit.
