6. CASE #Z08-009/JOHNSON The applicant, Larry Johnson (Marvin McGee, agent) is requesting a Zone Change on a 16.19-acre parcel from ER3M (Residential, one-acre minimum new lot size, single-family site-built and mobile homes) to EI2 (General Industrial, 5000 sq. ft. minimum new lot size) for the purpose of building a mini storage and recreational vehicle storage business as permitted in Section 3.1.N.3.b.1 of the Ordinance. The subject parcel is south of the City of Las Cruces, east of I-10 on the corner of Stern Dr. and Harper Rd. within Section 25, Township 24 South, Range 2 East, and can be further identified by Map Code # 4-012-143-333-012. The ETZ Commission at its regularly scheduled meeting on July 17, 2008, recommended approval with a 6-0-0 vote.

CASE # V08-003/SOWARDS The applicants, Tommy and Barbara Sowards, are requesting a Variance of eighteen feet (18’) from the rear yard setback of twenty feet (20’) for a two foot (2’) rear yard setback to accommodate a protective screening enclosure. The 0.37-acre parcel is zoned ER7 (Residential, 5,000 sq. ft. minimum new lot size, single family, duplex or apartments allowed), is located west of the City of Las Cruces, and is described as Lot 5, Block 3 of the Via Emma Subdivision in the Picacho Hills area. The subject property is addressed at 6755 Cordova Rd., is located within Section 8, Township 23 South, Range 1 East, and can be further identified by Map Code # 4-002-134-195-453. At its regularly scheduled meeting of June 25, 2008 the ETA voted 3-0-0 to postpone this case to July 23, 2008 due to the absence of two members. At its regularly scheduled meeting of July 23, 2008, the ETA voted 5-0-0 to postpone this case to this date.

8. CASE # A08-002/Amendment to the ETZ Zoning Ordinance. The ETA will consider the Authorization to Publish the Title and General Summary in order to amend the Las Cruces Extra-Territorial Zoning Ordinance (No. 88-02, as amended) at their meeting of August 18, 2008.

a. Title: Article II, “Administration of the Zoning Code”, Section 2.1.G, “Public Hearing and Notice Requirements”.

General Summary: This amendment proposes that ETZ notification requirements be modified to reduce the impact of postage on Doña Ana County and applicants. Certified mail, return receipt requested, will only be required for ETA final decisions on Zone Change requests or Initial Zoning Requests. It also strengthens the section addressing signs. It requires applicants to construct a sturdy sign backing and to post them for easier visibility.

9. CASE #V08-008/CLAUNCH: The applicants, Jerry and Shirley Claunch, are requesting a Variance of 18 ft. from the required rear yard setback of 25 ft., resulting in a 7 ft. setback, a Variance of 10.5 ft. from the required side yard setback of 15 ft. resulting in a 4.5 ft. setback, and a Variance of 2.5 ft. from the required 10 ft. eave to eave distance resulting in a 7.5 ft. setback between the primary structure and the accessory building, in the ER3 Zoning District to allow a recently constructed 624 sq. ft. garage. The 0.35-acre subject parcel is located north of the City of Las Cruces at 1985 Cochita Lane within Section 34, Township 22 South, Range 1 East, and can be further identified by Map Code # 4-004-132-384-327.
