CASE #Z07-007/Fairacres Baptist Church: The applicant is requesting a Zone Change on 3.64 acres from ER3 (Residential, 1-acre minimum new lot size, single-family site-built homes) to EC3 (Commercial District). The Zone Change will accommodate a proposed ETZ-replat and possible future expansion of the existing Fairacres Baptist Church. The subject parcels are located west of the Las Cruces city limits, fronting on West Picacho (US Hwy 70) and can be further identified by Map Code Numbers 4-003-135-090-462, and 4-003-135-107-458. The Extra-Territorial Zoning Commission at its regularly scheduled meeting on August 16, 2007, recommended, with a 7-0-0 vote, approval with conditions.

7. CASE ETZS-07-038A: An appeal of an ETZ Commission decision denying a preliminary plat for the Cielo Nogal Estates Subdivision. The subdivision consists of 32 proposed lots on 22.083+ acres. The property is located north of Carver Road, south of Calle De Las Margaritas, and immediately east of the Park Drain. The property is currently zoned ER4 (Residential, 0.5-acre minimum new lot size, site-built homes only). The ETZ Commission denied this preliminary plat request on August 02, 2007 by a vote of 0-6-1. Submitted by Summit Engineering for Cielo Nogal Estates, LLC.
