5. CASE# Z05-011/CHAVEZ: The applicant, Eddie Chavez, is requesting a Zone Change on 91.46-acres (three parcels) from ER3M (Residential, minimum lot size one (1) acre, single-family, site-built and mobile homes) and EC1 (Neighborhood Commercial) to EC1 (Neighborhood Commercial), EC2 (Community Commercial), ER3 (Residential, minimum lot size 1.0-acre, single-family, site-built homes), ER7 (Residential, 5,000sf minimum lot size, no individual septic systems allowed), and ECN2 (Private Conservation District, open space lands only). The Zone Change request is to acquire appropriate zoning for the development of a 32-lot subdivision, mixed uses, and commercial development along Peter Hurd Rd. The subject parcels are located east of Las Alturas Drive and south of Peter Hurd Road and can be further identified by Map Code # ‘s 4-010-139-503-406, #4-010-139-527-354, and #4-011-139-079-395. This Zone Change Request was APPROVED with conditions, by the ETZ Commission, by a 6-0-0 vote, on February 16, 2006.

6. CASE ETZS-05-098A: An appeal to reverse the denial decision of the Extra-Territorial Zoning (ETZ) Commission on a preliminary plat for a subdivision known as Puerta de Vista Subdivision. The preliminary plat included a waiver request for road improvements of approximately 4,000 ± linear feet on Achenbach Canyon Road from the entrance of the proposed development to Soledad Canyon Road. The subject property is located south of Achenbach Canyon Road. The preliminary plat proposes approximately 11 lots on 28.18 ± acres that is zoned ER-2 Residential District. Submitted by Gunaji-Klement & Associates, Inc. for Viking Development, LLC.

7. CASE#V06-002/MASON: The applicant, Rodger Mason, is requesting a variance to the two-acre minimum lot size standard within the ER2 Zoning District (Residential, 2-acre minimum new lot size, single family, site-built homes) in the Mason Acres Subdivision in pursuance of a lot split. The subject property is a 3.24-acres parcel with a 1,806 sq.ft. site built residence, a 700 sq.ft. detached garage, and a pole barn. The proposed lot split will create a 1.52-acre lot and a 1.72-acre lot. The parcel is located within Section 36, T22S, R1E, addressed at 3270 Doc Bar Court, and can be further identified by Map Code Number 4-006-132-015-513.

8. CASE#V06-003/DIAZ: The applicant, Robert Diaz, is requesting variances from the minimum 2-acre size lots within the ER2 Zoning District (Residential, 2-acre new lot minimum, single family site-built homes), for a lot line adjustment. The subject properties are 1.50-acre and 1.40-acre for a total of 2.90-acres zoned ER2. The lot line adjustment will create a 1.0-acre parcel and a 1.90-acre parcel. The parcels are located within Section 15, T22S, R1E, are addressed at 160 Diaz Rd. and can be further identified by Map Code Numbers 4-004-129-360-180, and 4-004-129-375-210.
