9. CASE#V05-022/HAMHILL CORPORATION: The applicant, Hamhill Corp.dba Durango Bagel, is requesting a Variance of 73 feet from the required 200 feet of staking lane to 127 feet to facilitate the compliance of a drive-thru lane for a coffee hut. The subject property is a 0.46-acre parcel and is zoned ER7M. The proposed commercial land use is grandfathered until April 2006. The parcel is the former of location of a Circle K convenience store. The property is located at 3895 S. Main, Mesilla Park NM and can be further identified by Map Code Number 4-008-138-219-144.

10. CASE#V05-023/GORMLEY: The applicant, Thomas Gormley, is requesting a Variance from the required 4-foot fence or wall to enclose a pool in the ETZ to the use of an automatic pool cover. The subject parcel is a 1.38-acre parcel and is zoned ER3. The parcel contains a 4,318sf site-built home, 1,250sf of accessory building, and a 16ft by 32ft inground pool. The property is located at 3203 McDowell Road, Las Cruces NM and can be further identified by Map Code Number 4-007-138-238-066.

11. CASE#Z05-010/ZULU PROPERTIES: The applicant, Zulu Properties, is requesting a zone change on 10.35 acres from ER2 (Residential, minimum new lot size 2.0-acre, single-family, site-built homes) to ER3 (Residential, minimum new lot size 1.0-acre, single-family, site-built homes). The zone change request is to acquire appropriate zoning for the development of a subdivision. The subject property is located immediately north of the Leasburg Extension, west of N.Valley Drive, and can be further identified by Map Code Number 4-005-132-018-518. The ETZ Commission recommends DENIAL of this Zone Change request. The ETZ Commission voted 0-4-0 for approval of this Zone Change request on December 15, 2005.

12. Action on ETZ Zoning Ordinance Amendment No. 2006-001. These minor amendments to the Extra-territorial Zoning Ordinance Sections 1.3 STATUTORY AUTHORITY AND JURISDICTION, 2.1.G PUBLIC HEARING AND NOTICE REQUIREMENTS, 2.1.K RESUBMISSION OF APPLICATION FOR A ZONING CHANGE, VARIANCE, OR SPECIAL USE PERMIT, and 3.2.E.3.b EV SPECIAL USE PERMITS were unanimously recommended for approval by the ETZ Commission on December 15, 2005.
