CASE # Z10-003, 004, 005, 006 / 4B TRUST: The applicant, 4B Trust, (Julie Ogaz, Agent), is requesting a Zone Change on 2 parcels totaling approximately 20 acres from ER3 (Residential, 1-acre minimum new lot size, single-family site-built homes) to EC3 (Planned Commercial District, 3.0-acre minimum lot size, retail shopping and personal services in a planned unit), and to ER7 (Residential, 5,000 sq. ft. minimum lot size, single-family, duplex or apartment units) on two parcels totaling approximately 80 acres for a mixed use development of commercial on the southern properties and residential on the northern properties. The applicant proposes to develop the two southern properties (approximately 20 acres), adjacent to Picacho Avenue, as the EC3 Commercial District after the 72 acre parcel is subdivided into two lots of 10 and 62 acres. The proposed commercial development will be located north of Picacho Ave. on the east and west sides of Picacho Hills Drive. The northern two properties (approximately 80 acres) will be developed as a residential development within the ER7 Zoning District. The subject properties are located northwest of the City of Las Cruces, at the intersection of Picacho Avenue and Picacho Hills Drive, within Section 16/17, Township 23 South, Range 1 East. The subject parcels are described as Tract #1, #2, and #3 of U.S.R.S Tract 8-8, Plat No. 1 as recorded in the Office of the Doña Ana County Clerk on October 2, 1996 in Plat 18, pages 546-547, and can be further identified by Map Code Nos. 4-003-135-050-330, 4-003-135-108-415, and 4-003-135-030-240. This case was postponed to this date at the regularly scheduled meeting of the ETZ Commission on August 19, 2010.

CASE # SU10-009/RATH: The applicants, Roberta & Lauren Rath, are requesting a Special Use Permit within the ER 3 Zoning District (Residential, 1-acre minimum new lot size, single-family site-built homes) to operate a private race horse training facility for the applicants’ horses on two parcels totaling 10-acres. The subject properties are located south of the City of Las Cruces within Section 15, Township 24 South, Range 2 East, and are addressed as 815 Ft. Fillmore Rd., Mesilla Park, NM 88047. They are described as Lots 1 and 2 of U.S.R.S Tract 15-13A6, Replat No. 1, as recorded in the Office of the Doña Ana County Clerk in Plat Record 22, Pages 603-604 on December 9, 2008, and can be further identified by Map Code Nos. 4-010-141-417-125 and 4-010-141-417-150.

CASE # Z10-008/MORENO: The applicants, Manuel and Martha Moreno, are requesting a Zone Change on a 10.00-acre parcel from ER 3/4 (Residential, 3/4-acre minimum new lot size, single-family site built homes) to EC 2 (Community Commercial, 5000 sq. ft. minimum new lot size) to construct a 23,200 sq. ft. special events center on the property. 9. CASE # Z10-007/SMITH: The applicants, Mary and William B. Smith, Scott Rutledge, Agent, are requesting a Zone Change on a 4.24-acre parcel from EC1 (Neighborhood Commercial, 5-acre maximum lot size, limited retail and service establishments serving nearby neighborhoods) to EC2 (Community Commercial, 5,000 sq. ft. minimum lot size, retail and personal services and some commercial recreational uses) for the purpose of developing a commercial retail and office center to be constructed in phases. The subject parcel is located south of the City of Las Cruces, east of NM Hwy 478, and is addressed as 4995 S. Main St. It is described as being a part of U.S.R.S Tract 13-17A3B of the Doña Ana Bend Colony Grant, within Section 4, Township 24 South, Range 2 East as recorded in the Office of the Doña Ana County Clerk on March 29, 1972, in Book 219, Page 488. The subject property can be further identified by Map Code # 4-009-139-082-277.
