6. CASE # SU09-007 / SAN PABLO: The applicant, San Pablo Mutual Domestic Water Consumers Association (MDWCA), Javier Jaramillo, Agent, is requesting a Special Use Permit within the ER3M Zoning District (Residential, 1-acre minimum new lot size, single-family site-built and mobile homes) to construct an approximate 2,500 sq. ft. building to be used as a Meeting/Office/ Maintenance Building for the San Pablo MDWCA. Pursuant to Article 3, Section 3.1.C.1.d, a public utility facility requires a Special Use Permit within the ER3M District. The 0.75-acre parcel is addressed as 4615 Lamar Rd., Las Cruces, NM 88005, and is located within Section 5, Township 24 South, and Range 2 East. The subject property is described as a part of Tract 13-18A, of the Mesilla Civil Colony Grant, as re-recorded in the Office of the Doña Ana County Clerk in Book 284, Pages 331-332 on December 1, 1983, and can be further identified by Map Code # 4-008-139-390-268.

7. CASE # SU09-006 / FAMILIES AND YOUTH, INC.: The applicant, Families and Youth, Inc., Melanie Studier, agent, is requesting a Special Use Permit to construct a 160 sq. ft. accessory building with a bathroom. The 2.17-acre subject parcel is zoned ER 4 (Residential, ½-acre minimum new lot size, single-family site-built homes) addressed as 2211 N. Valley Dr., and is described as part of USRS Tract 7-28D and 9B-23, recorded on August 2, 1996 in Book 60, Pages 891-896 in the Office of the Doña Ana County Clerk. The applicant was granted a Special Use Permit on Appeal to the Extra-territorial Zoning Authority (ETA) on March 17, 1999 (Case # SU98-026) to build a second building on the property with the condition that “No future expansions of this group home[‘s] facilities shall be allowed without a new application for a[n] SUP, Zone Change, or other appropriate administrative process.” The parcel is located on the north border of the City of Las Cruces, within Section 11, Township 23 South, and Range 1 East, and can be further identified by Map Code # 4-005-134-420-063.

8. CASE # Z08-011/BLACK: The applicant, Tommy Black, (David Bollschweiler, Agent) is requesting a zone change on 4 parcels from ER3M (Residential, 1-acre minimum lot size, single-family site built and mobile homes) to EI3 (Special Industrial District, to provide for a variety of industrial uses that may cause some levels of air or noise pollution) for the purpose of operating an existing auto/metal salvage yard. The applicant is also requesting a Special Use Permit SU08-011/Black, as required in Section 3.1.O of the ETZ Zoning Ordinance. The combined 8.85-acre subject parcels are located north of the City of Las Cruces, east of Interstate 10, within Section 13, Township 22 South, and Range 1 East. The subject properties are addressed at 1430 East Thorpe Road. The four parcels described as parts of Lots 5 and 19, Block 20 of the Elephant Butte Land and Trust Company Subdivision “A” as recorded in the Office of the Doña Ana County Clerk on March 1, 1911 in Book 8, Page 86 and Lot 1 of the Elephant Butte Land & Trust Company Subdivision “A” Replat No. 31 as filed in the Office of the Doña Ana Clerk on November 13, 1995 in Book 18, Pages 352-353. The four parcels can be further identified by Map Code Nos. 4-006-129-137-460, 4-006-129-188-491, 4-006-129-185-507, and
4-006-129-153-514.
