6. CASE # SU09-005 / ORTIZ: The applicants, Jesus and Rita Ortiz, are requesting a Special Use Permit to place a 1568 sq. ft. double-wide ground-set mobile home on their property as accessory living quarters. They seek to remove and replace the existing 840 sq. ft. single-wide mobile home, which had been designated as an accessory living quarters on the parcel by a 2001 SUP (Case # SU01-009 - which expired in 2005) based on a medical hardship. The 2.44-acre parcel is zoned ER 3 (Residential, one-acre minimum new lot size, single-family site-built homes), with a 1600 sq ft. site-built home serving as the primary residence. It is addressed as 5690 Beehive Lane, and is described as part of Lot 19, Block 9 of the Elephant Butte Land and Trust Company Subdivision “C” plat recorded on July 18, 1911 in Book 4, Page 43 in the Doña Ana County Clerk’s Office. The property is within Section 7, Township 22 South, and Range 2 East and is located north of the City of Las Cruces, east of Del Rey Blvd. and can be further identified by Map Code # 4-007-128-150-430.

CASE # Z09-002 / WOODMAN: The applicant, Mark Woodman, is requesting a Zone Change on the eastern 1.5-acres of a 2.84-acre parcel from ER 4 (Residential, ½-acre minimum new lot size, single-family site-built homes) to EC 2 (Commercial, Community Commercial District, 5,000 sq. ft. minimum new lot size) to place this parcel, where the commercial business, Mesilla Valley Snacks, Inc. operates, under one uniform zoning district. Currently, the zoning boundary bisects the commercial building on the property. A Zone Change application to acquire EC 2 Zoning was submitted in June 1993, and the ETZ Commission recommended approval (5-0-0) on July 15, 1993. However, there is no record of the ETZ Authority ever taking action for final approval of that Zone Change request. The parcel is located west of the City of Las Cruces and is addressed as 5350 W. Picacho Ave. It is described as being that part of the S½, SW¼, NE¼, NE¼, of Section 20, Township 23 South, Range 1 East, of the U.S.G.L.O. Surveys, recorded on May 7, 1993 in Book 369, Page 757 in the Doña Ana County Clerk’s office and can be further identified by Map Code #
4-002-136-416-115.
