The Las Cruces Extra-Territorial Zoning Commission agenda for a public hearing to be held on Thursday, April 2, 2009 at 7:00 p.m. in the County Commission Chambers at 845 N. Motel Boulevard, Las Cruces, New Mexico.

1. Case ETZS-09-002W: A request to waive the required dedication of right-of-way to Pajaro Road and New Mexico State Highway 28 for a subdivision known as Biad Farm Subdivision. In lieu of dedication of right-of-way the applicant will provide a road easement to both Pajaro Road and New Mexico State Highway 28. In addition, the applicant is also seeking to waive the required dedication of 50-feet right-of-way for internal roadways. The subject property is located on the southwest corner of New Mexico State Highway 28 and Pajaro Road. Submitted by Victor and Sandy Biad, property owners.

V. NEW BUSINESS
1. Case ETZS-08-008a: A request to appeal the approval of a final plat for Ladera Canyon Estates on February 9, 2009. Ladera Canyon Estates is a Large Land Area Subdivision that includes 4 residential lots on 26.28 +/- acres of vacant land. Submitted by Greg Green, appellant.

2. Case ETZS-07-069: The applicant is seeking preliminary plat approval and a waiver to regulations for applicable design standards to road improvements for a proposed subdivision known as Sunset Ridge Heights. The preliminary plat proposes 35 lots in ER3 zoning (Single-Family, one-acre minimum lot size), on a total of 40 ± acres. The waiver request is for the use of Dona Ana County Design Standards for road improvements to Desert Wind Way in lieu of City of Las Cruces Design Standards. Desert Wind Way is classified as a Principal Arterial (120-feet right-of-way) per the MPO Thoroughfare Plan. The subject property is located on Desert Wind Way northeast of La Reina Street.
