6. CASE #Z08-012/STAHMANN, INC: The applicant, Stahmann, Inc. (Jorge Moy, agent) is requesting a Zone Change on a 507.64-acre parcel from ER (Reserve District, 20-acre minimum parcel size) to ER 2 (Residential, single-family site-built homes, 2-acre minimum new lot size) to subdivide at a later date into three proposed tracts of 420.709-acres (Tract A), 81.929-acres (Tract B), and 6.475-acres (Tract C). The property will remain in agricultural production, but the applicant seeks to comply with a distribution of lands to the heirs of this property. The subject parcel is south of the City of Las Cruces, bordering the Santo Tomas Lateral west of NM Hwy 28 near the Rio Grande within Section 29, Township 24 South, Range 2 East, and can be further identified by Map Code # 4-008-142-050-480. The ETZ Commission, at its regularly scheduled meeting on September 18, 2008, voted 6-0-0 to postpone the case to this date.

7. CASE #SU08-013/HARSE: The applicant, Jay Harse, is requesting a Special Use Permit within the ER4 Zoning District (Residential, 1/2-acre minimum new lot size, single-family site built homes) to construct an 1,820 sq. ft. accessory living quarters. The applicant is also seeking a 220 sq. ft. Variance to the 1,600 sq. ft. maximum size requirement of Section 7.2.A of the Ordinance. This 1.61-acre parcel is located north of the City of Las Cruces, within Section 2, Township 23 South, Range 1 East, and is addressed at 2600 San Andres Drive. The subject property is described as Part of Lot 18, Block A, of the San Andres Estates Subdivision, and can be further identified by Map Code # 4-005-133-236-427.

8. CASE # SU08-014/ELLIOTT: The applicants, Doyle and Catherine Elliott, (Ray Mancera, agent), are requesting a Special Use Permit to a) erect a Commercial Tower in a Residential Zone per Section 4.2.E.2.b of the Ordinance, and b) exceed the maximum height of 75’ in order to build a 90’ monopole tower per Section 4.2.E.2.a.1 of the ETZ Ordinance. This 11.30-acre parcel is zoned ER3 (Residential, 1-acre minimum new lot size, single-family site-built homes), located south of the City of Las Cruces, and is addressed at 5503 South Highway 28. It is described as Lot 1 of the Elliott Tracts, within Section 8, Township 24 South, Range 2 East and can be further identified by Map Code # 4-008-140-364-392.
