The Doña Ana County Planning and Zoning Commission will consider the following land use cases at their regular meeting to be held on Thursday, May 24, 2007 at 9:00 a.m., in the County Commissioner’s Chambers at Doña Ana County Government Center, 845 N. Motel Boulevard, Las Cruces, New Mexico.

VARIANCE

3. Case# CV07-004: Submitted by Roman Garcia, a request for a Variance to minimum road access standards within the Performance District in order to obtain a Claim of Exemption. Doña Ana County Land Use Regulation and Zoning Ordinance requires 50’ of Right of Way with 24’ of improved roadway. The applicant is proposing 10’ of ROW with no improvements. The Claim of Exemption will subdivide the 15.56-acre lot into two (2) parcels of 14. 56-acres and 1-acre. The applicant intends to retain the 1-acre parcel. The applicant has submitted a pavement analysis report indicating the existing roadway is adequate for existing traffic loads. Distance from the proposed lot to the nearest public right-of-way (New Mexico Highway 28) is approximately 850’. The subject parcel is located at 225 West Ojito De Madrid and is located in Township 26S, Range 3E, Section 31 and can be further located by Map Code # 4-014-156-025-235.

4. Case# CV07-005: Submitted by Kevin Camunez, a request for a Variance to the minimum road access standards in order to obtain a Claim of Exemption. The Dona Ana County Land Use Regulations and Zoning Ordinance Section 9.2.D requires a minimum road width of 50 feet with 24’ of improved roadway. The applicant is proposing 15’ of right-of-way with 14’ of paved surface. The Claim of Exemption will subdivide the 2.59-acre lot into a 1-acre lot and a 1.59-acre lot. The 2.59-acre property is located at 426 Camunez Road, San Miguel NM and is within Township 25S, Range 2E, Section 10. Further, the subject property can be identified by Map Code # 4-010-146-323-082.
