A Word from the Assessor
Dear Property Owner,
As of January 1, 2004 New Mexico law requires the disclosure of residential sales information to the County Assessor. This must be accomplished by filing a notarized affidavit at the Assessor's Office within 30 days of the date of filing a deed, real estate contract or memorandum of real estate contract with the County Clerk.
The information will be used for statistical and analytical purposes and will help us determine fair market value of all properties. It will also help ensure fair and equitable property tax assessments for all taxpayers throughout our county. All information collected is required to be kept confidential with the Assessor's office, and will not be made available as public information.
There are limited exceptions for some residential transactions. Please refer to the back page of the affidavit under: 7-38-12.1 - D (1 through 16).
Failure to comply with the law could result in a conviction of a misdemeanor and punishable by the imposition of a fine of not more than one thousand dollars.
My staff and I are available to answer any questions regarding the law, or to provide free notary service for this purpose. My office is located at 845 N. Motel Blvd. in Las Cruces. You can also contact us by telephone at 575-647-7400 Monday through Friday, 8 a.m. to 5 p.m., except on holidays.
Thank you for your cooperation.
Sincerely,
Eugenia (Gina) Montoya Ortega
